I'm going to assume that you haven't read the contract they have, or even tried to understand the key points of it. So you don't know how strong their argument actually is. When you place an order is less important than the agreed terms for fulfilling each other. If Brexit has shown us nothing else, it is that the EU seems to give more attention to the detail on contracts than the UK.

What's wrong with telling like it is? The EU is a bureaucratic mess. They've ordered 2.3 Billion doses of vaccine from 7 different companies. 3 times the requirement for 2 doses every EU citizen. AZ is the only company now delivering vaccine at the moment. AZ hasn't yet been approved for use in the EU, but they want it anyway they can get it, even if it means stealing!!

Having looked at the contract, this seems rather an odd story. The EU doesn't have a leg to stand on. 'Best reasonable efforts' is clearly defined, and clearly applies to the manufacturing because that's explicitly stated.

To be frank, it appears that this one catastrophic error in ordering vaccines outweighs every mistake the UK government has made.
